1. Acceptance of Terms

By accessing or using the Samparkasetu Software Solutions Private Limited platform ("Platform"), website, or any associated mobile applications, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the Platform.

These Terms apply to all users including farmers, dealers, manufacturers, distributors, financial institutions, and any other participant in the Samparkasetu Software Solutions Private Limited ecosystem.

2. Platform Use

Samparkasetu Software Solutions Private Limited grants you a limited, non-exclusive, non-transferable licence to access and use the Platform for your internal business purposes, subject to these Terms.

You agree to use the Platform only for lawful purposes related to agriculture, agri-business operations, and activities that are consistent with Samparkasetu Software Solutions Private Limited's mission of connecting India's agriculture ecosystem.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.

3. Accounts & Registration

To access certain features you must register an account. You agree to provide accurate, complete, and current information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@samparkasetu.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or are found to contain false information.

4. Prohibited Conduct

You must not:

• Use the Platform for any fraudulent, misleading, or illegal activity.
• Scrape, crawl, or extract data from the Platform without written permission.
• Interfere with or disrupt the Platform's infrastructure or security.
• Upload malicious code, viruses, or harmful software.
• Impersonate any person, business, or entity.
• Misrepresent your identity, qualifications, or business credentials.
• Post or distribute content that is defamatory, obscene, or violates third-party rights.

5. Intellectual Property

All content, trademarks, logos, software, and technology on the Platform are the exclusive property of Samparkasetu Software Solutions Private Limited or its licensors. You receive no ownership rights by using the Platform.

Content you submit to the Platform (e.g., product listings, reviews, data) remains yours, but you grant Samparkasetu Software Solutions Private Limited a worldwide, royalty-free licence to use, display, and distribute it for Platform operations.

6. Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we collect, use, and protect your data.

7. Payments & Billing

Certain features of the Platform require payment of fees as described in your subscription plan or service agreement. All fees are quoted in Indian Rupees (INR) and are exclusive of applicable taxes unless stated otherwise.

Payments are processed through secure third-party payment gateways. Samparkasetu Software Solutions Private Limited does not store your payment card details. Subscription fees are charged in advance and are non-refundable except as set out in our Refund Policy.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

Samparkasetu Software Solutions Private Limited does not guarantee the accuracy of market prices, weather data, crop advisory, or any third-party information available through the Platform. You should verify critical decisions independently.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Samparkasetu Software Solutions Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if advised of such possibility.

Our total aggregate liability to you for any claim shall not exceed the amount you paid to Samparkasetu Software Solutions Private Limited in the three (3) months preceding the claim.

10. Termination

You may stop using the Platform at any time. Samparkasetu Software Solutions Private Limited may suspend or terminate your access immediately if you breach these Terms or engage in conduct that harms the Platform or other users.

Upon termination, provisions that by their nature should survive (including IP, liability, and governing law) will continue to apply.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Davanagere, Karnataka, India.

We reserve the right to amend these Terms at any time. Continued use of the Platform after changes constitutes your acceptance of the revised Terms.
